If you are serving coffee in a drive-through setting in flimsy cups, you have to know that spilling is likely to happen occasionally. If you know spills are likely to be a common and frequent occurrence, you have partial responsibility not to serve the coffee at a temperature where an incidental spill can cause life-threatening burns. Furthermore, people should have a reasonable expectation when buying coffee at a McDonald's that the coffee will not be dangerously hot.
