We in South Dakota are still on hold waiting for the judge to issue a ruling after hearing on Oct 16th. I listen to local talk radio in the mornings. People here are really changing their minds about this now they realize how much the state is going to be paying out if they take this to the Supreme Court and lose. So far over 40 lawyers have signed on to help the plaintiff's attorneys. If the state loses at the Supreme Court level they are going to have to pay allllllllllllll the fees of allllllllllllllllllllllll the lawyers....

Many times...the only thing on my mind at the end is who will be appointing the judges....

here's a quote from the opinion, stress added. From the vantage point of 2014, it would now seem, the question is not whether American law will allow gay couples to marry; it is when and how that will happen. The judges are trying define who has the responsibility for making it legal. #1, Should it be decided in state legislatures? #2. Should it be decided by referendum? #3. Should the courts rule on it? Here's something to think about. If civil rights had been decided by #1 or #2 they would not have enacted for the whole nation for at least 20 years after Martin Luther King's time. State legislatures and referendums don't determine what is right. They determine what is most popular by majority vote. That's when democracy becomes a tyranny of the majority. The judges admit that marriage for gays is inevitable. They haven't ruled against it. It's likely the Supreme Court might send it back to them to rule on. |
